Terms of Service

These Terms of Service govern your access to and use of TagPass, the Digital Product Passport platform operated by Musivo LLC of Tornado Tower, Doha, Qatar ("TagPass", "we", "us"). By creating an account or using the service you agree to these terms.

The service

TagPass provides software for creating, hosting, publishing and maintaining Digital Product Passports, including generation of machine-readable identifiers such as QR codes and GS1 Digital Link URIs, public passport pages, data validation and export tools.

TagPass is a software service provider. We are not a certification body, notified body, conformity assessment body, testing laboratory or legal adviser.

Compliance responsibility

Regulatory requirements for Digital Product Passports are being introduced progressively and vary by product category and jurisdiction. TagPass does not warrant that any passport created using the service satisfies any particular legal requirement.

You remain the economic operator for your products. You are solely responsible for the accuracy, completeness, lawfulness and timeliness of all product data you enter, upload or publish, and for determining which obligations apply to your products.

Accounts

You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old and authorised to act for the organisation you register.

Subscriptions and payment

Paid plans are billed in advance on a monthly or annual basis and renew automatically until cancelled. Your plan determines the number of active (published) passports you may maintain. Fees are exclusive of applicable taxes.

You may cancel at any time; cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable.

Your data and ownership

You retain all rights in the product data, images and documents you provide ("Customer Data"). You grant us a limited licence to host, process, reproduce and publicly display Customer Data solely to operate the service, including serving public passport pages you have chosen to publish.

Identifiers based on your own GS1 company prefix remain yours. You may export your data at any time in a structured format.

Acceptable use

You must not use the service to publish false, misleading or unlawful product information, infringe third-party rights, upload malicious code, attempt to gain unauthorised access, scrape or overload the platform, or resell the service without written agreement.

Availability

We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance and may modify or discontinue features, giving reasonable notice of material adverse changes where practicable.

Suspension and termination

We may suspend or terminate your account for material breach of these terms, non-payment, or unlawful use. Following termination we will retain your data for 30 days to allow export, after which it may be permanently deleted.

Warranties and disclaimers

Except as expressly stated, the service is provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including fitness for a particular purpose, merchantability, accuracy or non-infringement.

Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill or data. Our total aggregate liability arising out of or relating to the service is limited to the fees you paid to us in the twelve months preceding the event giving rise to the claim.

Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud or wilful misconduct.

Indemnity

You will indemnify and hold us harmless against claims, losses and reasonable costs arising from your Customer Data, your products, or your breach of these terms or applicable law.

Changes to these terms

We may update these terms from time to time. Material changes will be notified by email or in-product notice at least 30 days before taking effect. Continued use after that date constitutes acceptance.

Governing law

These terms are governed by the laws of the State of Qatar. The courts of Qatar have exclusive jurisdiction, without prejudice to any mandatory consumer protection rights you may have in your country of residence.
